HOW TO APPLY FOR MAINTENANCE SOUTH AFRICA.
In terms of the Common Law, both parents must support their children, proportionately and in accordance with their means.

Measure of Support

Food, clothing, accommodation, educational expenses, as well as the provision of the amenities of utilities, transport, medical expenditure, pets, pocket money and other living expenses, are taken into account in calculating how much maintenance should receive.

Duty of Support

The Children’s Act 38 of 2005, provides that a parent has a responsibility to contribute to the maintenance of his / her child. A parent can not evade such duty, even after divorce and remarriage. The Maintenance Act 99 of 1998, provides that a maintenance order for the maintenance of a child is the enforcement of the Common Law duty of the child’s parents to support that child. 

How to Apply for Maintenance 

An Applicant may approach the Maintenance Court situated in all Magistrate’s Court having jurisdiction over where the child is resident. 

Where divorce proceedings exist, a party may approach the Court seized with the divorce for maintenance pendente lite.
