PROSECUTORIAL BAIL
Section 59A of the Criminal Procedure Act, provides what is known as Prosecutorial Bail.

Introduction

Section 59A of the Criminal Procedure Act, provides what is known as Prosecutorial Bail.

This allows a Prosecutor to authorise the release of an accused person charged with offences listed in schedule 7 on bail, after consulting with the investigating Officer.


Court Appearance

The accused released under this section must appear in court on the first court day at the time and place set by the Prosecutor.

Schedule 7 Offences

  • Culpable Homicide
  • Assault with Intent to do Grevious Bodily Harm
  • House Breaking
  • Robbery (below R 20 000.00)
  • Theft / Fraud (below R 20 000.00)
  • Possession of Drugs (below R 20 000.00)
  • Extortion 
  • Forgery or Uttering
